As an Australian-based dropshipping retailer powered by Shopify, we curate quality gadgets sourced from trusted global suppliers, which may ship from international locations, ensuring competitive prices and a seamless shopping experience. These Terms of Service (“Terms”) outline your rights and responsibilities when using our Services.
By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, you must not use or access our Services. These Terms comply with Australian Consumer Law (ACL) and do not affect your statutory rights. Please read them carefully, as they include important information about warranties, liability, and your obligations.
1. Access and Account
By using our Services, you confirm that you are at least the age of majority in your state or territory of residence (18in NSW for certain contracts) and have the legal capacity to enter into these Terms. You also consent to allowing any minor dependents to use the Services on devices you own, purchase, or manage.
To access certain features (e.g., browsing, purchasing, or account creation), you may need to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that all provided information is accurate, current, and complete, and that you have the right to provide it. You are responsible for maintaining the security of your account credentials and all account activity. Accounts are non-transferable and may not be sold, assigned, or licensed to others.
If we suspect unauthorized or fraudulent activity, we may suspend or terminate your account without notice, in accordance with Section 14.
2. Our Products
We strive to accurately represent our products in our online store. However, due to device settings or screen variations, colors, appearance, or quality may differ from what is displayed. Product descriptions, specifications, and availability are subject to change without notice at our discretion. We reserve the right to discontinue products or limit quantities offered to any person, region, or jurisdiction on a case-by-case basis.
Under ACL, products must be of acceptable quality, fit for purpose, and match their description. Your rights to remedies for non-compliant products are outlined in our Refund Policy.
3. Orders
Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion. An order is not confirmed until we process payment and send you an order confirmation email. We may decline or cancel orders for reasons including stock unavailability, pricing errors, or suspected fraud. We may offer promotions with separate terms, which will take precedence over these Terms in case of conflict. You agree to provide accurate and complete payment and account information and to update it promptly as needed. You warrant that: (i) your payment information is true and complete, (ii) you are authorized to use the payment method, (iii) charges will be honored by your payment provider, and (iv) you will pay all charges, including applicable taxes and shipping fees.
5. Shipping and Delivery
Our Shipping Policy governs delivery processes. As a dropshipping retailer, we coordinate with third-party suppliers and carriers (e.g., Australia Post, Sendle), which may result in delivery times of 7–11 business days for standard shipping or 2–5 business days for express shipping, depending on your location. Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or external factors (e.g., weather, peak periods). Title and risk of loss transfer to you once the product is handed to the carrier.

6. Intellectual Property
All content on our Services, including trademarks, logos, text, images, graphics, reviews, videos, and their design and arrangement, is owned by GizmoGlow, its affiliates, or licensors and is protected by Australian and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, display, publish, or transmit any content without our prior written consent. Unauthorized use may violate intellectual property laws.
GizmoGlow’s names, logos, and slogans are our trademarks. Shopify’s trademarks are owned by Shopify. Other trademarks belong to their respective owners. No license or right is granted except as expressly stated in these Terms.
7. Optional Tools
Our Services may include third-party tools (e.g., payment processors, analytics) provided “as is” and “as available” without warranties or endorsements. Your use of these tools is at your own risk, and you should review the third-party provider’s terms. We are not liable for any issues arising from your use of these tools. New features or tools introduced to the Services are also subject to these Terms.

We do not monitor or control these sites and are not responsible for their content, accuracy, or practices. Accessing third-party sites is at your own risk, and you should review their policies before engaging in transactions. 9. Relationship with Shopify
GizmoGlow is powered by Shopify, which hosts our Services. All sales are made directly with GizmoGlow, not Shopify. Shopify is not responsible for any aspect of your purchases, including any injury, damage, or loss. By using our Services, you release Shopify and its affiliates from all claims or liabilities related to your transactions with GizmoGlow.
10. Privacy Policy
Personal information collected through our Services is governed by our Privacy Policy and, where applicable, Shopify’s Privacy Policy. By using our Services, you acknowledge that you have read these policies. Information may be shared with global suppliers or Shopify to fulfill orders or provide Services, in compliance with Australian Privacy Principles (APP).
11. Feedback
By submitting feedback, reviews, suggestions, or other content, you grant GizmoGlow a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and distribute it for any purpose, including commercial use. You warrant that: (i) you own or have rights to your Feedback, (ii) you disclose any compensation received for Feedback, and (iii) your Feedback complies with these Terms.
We may monitor, edit, or remove Feedback deemed unlawful, offensive, or in violation of these Terms or third-party rights. Feedback must not infringe intellectual property, privacy, or other rights, contain unlawful or abusive content, or include viruses or malware. You are responsible for the accuracy of your Feedback, and we are not obligated to maintain its confidentiality, pay compensation, or respond to it.
12. Errors, Inaccuracies, and Omissions
Our Services may occasionally contain typographical errors, inaccuracies, or omissions (e.g., in product descriptions, pricing, or availability). We reserve the right to correct these errors, update information, or cancel orders without prior notice, even after order submission. Sections that survive termination include Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and other provisions that should naturally survive.
15. Disclaimer of Warranties
Except as provided under ACL, the Services and products are provided “as is” and “as available” without warranties, express or implied, including for merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free. Information on the Services is for general purposes, and we disclaim liability for reliance on it. ACL consumer guarantees apply and cannot be excluded; see our Refund Policy for details.
16. Limitation of Liability
To the fullest extent permitted by law, GizmoGlow, our affiliates, partners, officers, employees, agents, contractors, licensors, and Shopify are not liable for any direct, indirect, incidental, punitive, special, or consequential damages (e.g., lost profits, data, or savings) arising from your use of the Services or products, even if advised of the possibility. Your ACL rights to remedies for faulty products or services remain unaffected.
17. Indemnification
You agree to indemnify, defend, and hold harmless GizmoGlow, Shopify, and our affiliates, partners, officers, employees, agents, contractors, and licensors from any claims, damages, liabilities, or losses (including reasonable attorneys’ fees) arising from: (i) your breach of these Terms, (ii) your violation of any law or third-party rights, or (iii) your use of the Services. We will notify you of any indemnifiable claim and may control its defense and settlement, but we will not impose non-monetary obligations on you without your consent. You must cooperate in the defense.
18. Severability
If any provision of these Terms is unlawful, void, or unenforceable, it will be enforced to the extent permitted by law, and the unenforceable portion will be severed without affecting the remaining provisions.
19. Waiver; Entire Agreement
Our failure to enforce any right or provision does not constitute a waiver. These Terms, along with our Privacy Policy, Shipping Policy, and Refund Policy, form the entire agreement between you and GizmoGlow, superseding any prior agreements or communications. Ambiguities will not be construed against the drafting party.

You may not assign or transfer these Terms or your rights without our prior written consent. We may assign or transfer these Terms without your consent or notice.
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You and GizmoGlow consent to the exclusive jurisdiction and venue of the courts in New South Wales for any disputes arising from these Terms or the Services.

Headings are for convenience only and do not affect the interpretation of these Terms.
23. Changes to Terms of Service
